Welcome to Amaspace (https://amaspace.co). By accessing or using our platform, you agree to these Terms and Conditions (the "Terms"). If you do not agree to these Terms, you may not access or use our services. These Terms apply to all users, customers, and visitors who access or use Amaspace’s services, software, website, or mobile applications (together, the "Service").

1. Definitions

  • Service — Amaspace’s suite of tools and services that enable users to create, customize, and integrate 3D models and product configurators into their e-commerce websites.
  • Content — all user-generated material created, uploaded, or otherwise contributed to the Amaspace platform, including but not limited to 3D models, configurations, designs, text, images, and any other materials.
  • User / Customer — any individual or entity who registers for an account or otherwise uses the Amaspace platform.
  • Subscription — the paid plans offered by Amaspace that give users access to certain features or services.
  • Account — the individual or business profile that a user creates when signing up for the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By registering an account, you certify that you are at least 18 years old. The Service is not available to anyone previously removed or banned from the platform. Amaspace reserves the right to refuse service to anyone, for any reason, at any time.

3. Accounts and Account Responsibilities

You are responsible for safeguarding the confidentiality of your account credentials and agree to notify Amaspace immediately of any unauthorized use of your account or any other security breach. Amaspace will not be liable for any loss or damage resulting from unauthorized access to your account or from your failure to comply with these security obligations.

4. Intellectual Property

  • Amaspace’s rights. All content and materials on the platform — including but not limited to software, code, graphics, and text — are the intellectual property of Amaspace or its licensors. You may not use, reproduce, or distribute any part of Amaspace’s intellectual property without Amaspace’s express written permission.
  • Your rights. You retain ownership of the 3D models, configurators, and other Content you create using the platform. By creating Content using the platform, you grant Amaspace a non-exclusive, royalty-free, worldwide, perpetual license to use, host, display, and distribute that Content as necessary to provide the Service (for example, to host it or integrate it into e-commerce platforms).

5. Payment and Subscriptions

  • Billing and payment. Amaspace offers various subscription tiers. You are required to provide accurate and up-to-date payment information. Payments are processed through third-party payment providers, and all fees are billed in advance for the selected billing period (monthly or annually).
  • Refunds. Subscription fees are non-refundable except where required by law or under specific circumstances (for example, technical issues that prevent access to the Service). You may cancel your subscription at any time, but no refunds are provided for any unused portion of a billing period.
  • Fee changes. Amaspace reserves the right to modify subscription fees with prior notice. You will be notified by email or by a notification on the platform before any such change takes effect.

6. Acceptable Use

You agree to use the platform in accordance with all applicable laws and regulations. The following are strictly prohibited:

  • Hacking or tampering — any attempt to hack, reverse engineer, or tamper with Amaspace’s platform or services.
  • Illegal activities — engaging in fraudulent, deceptive, or otherwise unlawful activities.
  • Disruption — interfering with or disrupting the Service, or the servers or networks connected to the Service.
  • Impersonation — impersonating another person or misrepresenting your affiliation with any person or entity.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Amaspace disclaims all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Amaspace makes no guarantees regarding the uptime, reliability, or fitness of the platform for any specific purpose.

8. Limitation of Liability

To the fullest extent permitted by law, Amaspace is not liable for:

  • loss of data or Content you create on the platform;
  • damages resulting from errors, service interruptions, or downtime; or
  • any indirect, incidental, or consequential damages, including lost profits or business, arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Amaspace, its affiliates, and its employees from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

10. Termination

Amaspace reserves the right to terminate or suspend your account and access to the Service at its sole discretion, without notice, for conduct that it believes violates these Terms or is harmful to other users or the platform. Upon termination, any outstanding payments become immediately due.

11. Changes to These Terms

Amaspace reserves the right to update these Terms at any time. We will notify you of any material changes by email or by a platform notification. Your continued use of the Service after such changes take effect constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms, and any disputes arising under them, are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-law principles.
